1. Introduction

These Terms and Conditions (“Terms”), together with our Privacy Policy, apply to your use of the website https://itap.qa/ (“Site”), your purchase of our Products (NFC Cards), and the use of our digital services (“Services”).

For the purposes of these Terms, “You” refers to the user of the Site or purchaser of the Products. “iTap”, “We”, “Our”, or “Us” refers to iTap, a company registered in the State of Qatar.

By accessing, browsing, or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use our Site or Services.

2. Definitions & Interpretation

In these Terms:

“Account” means the digital account created by you to manage your digital business card profile.
“Products” means the physical NFC cards or accessories sold by iTap.
“Services” means the digital platform, dashboard, and hosting of your digital profile provided by iTap.
“User Content” means any text, images, contact details, or links you upload to your iTap profile.
“Qatar Laws” refers to the applicable laws and regulations of the State of Qatar.

3. Use of Site and Services

You agree to use the Site and Services only for lawful purposes. You must not:

Use the Services to host or display content that is offensive, defamatory, obscene, or violates the public morals of the State of Qatar.
Attempt to hack, reverse-engineer, or compromise the security of the iTap platform.
Use the Services for fraudulent activities, phishing, or spamming.
Upload content that infringes on the Intellectual Property Rights of others.

We reserve the right to suspend or terminate your Account immediately if you breach these obligations.

4. Orders and Contracts

Order Acceptance: Your order constitutes an offer to purchase. A contract is formed only when we send you a confirmation email that your order has been processed.
Availability: All orders are subject to product availability. We reserve the right to cancel orders if stock is unavailable, and we will refund any payments made.
Custom Orders: For cards requiring custom printing (Logos/Names), you are responsible for providing accurate design files. Once the printing process begins, the order cannot be cancelled or refunded.

5. Fees and Payments

Pricing: All prices listed on the Site are in Qatari Riyals (QAR) unless otherwise stated.
Taxes: Prices may be subject to applicable taxes or duties as per Qatar regulations.
Payment: We accept payment via the methods displayed at checkout (e.g., Credit Cards, Debit Cards, Apple Pay). You warrant that you are authorized to use the chosen payment method.
Subscription Fees (If applicable): If you subscribe to premium software features (SaaS), fees are billed in advance on an annual or monthly basis. Failure to pay may result in a downgrade or suspension of premium features.

6. Delivery

Local Delivery: We aim to deliver orders within Qatar within 24-48 hours (or as specified at checkout). Delivery times are estimates and not guarantees.
International Shipping: For orders outside Qatar, you are responsible for any customs duties or import taxes applicable in your country.
Risk: Risk of loss or damage to the Products passes to you upon delivery to the address you provided.

7. Returns and Refunds

Standard (non-custom) products can be returned within [Insert Days, e.g., 14] days if unopened.
Customized products cannot be returned unless they are faulty or verified as having a manufacturing defect.

8. Intellectual Property

Our IP: iTap owns all rights to the Site design, code, logo, and software. You may not copy or reproduce any part of our intellectual property without written consent.
Your IP: You retain ownership of the content (photos, logos, contact info) you upload to your profile. By uploading it, you grant us a license to display and host this content for the purpose of providing the Service.

9. Limitation of Liability

To the maximum extent permitted by Qatar Law:

The Services are provided “as is” and “as available”. We do not guarantee that the Site will be error-free or uninterrupted.
iTap shall not be liable for any indirect, consequential, or incidental damages (including loss of data, profits, or business opportunities) arising from your use of the Products or Services.
Our total liability to you for any claim shall not exceed the amount you paid to us for the Product or Service in the last 12 months.

10. Privacy and Data Protection

We handle your personal data in accordance with Qatar Law No. 13 of 2016 concerning Personal Data Privacy Protection. Please review our Privacy Policy to understand how we collect and use your data.

11. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Qatar. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Doha, Qatar.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Site. Your continued use of the Site constitutes acceptance of the modified Terms.
